The entry into force of the new Law of Tourism, Leisure and Hospitality of the Valencian Community is causing concerns among the residents of Xàbia and professionals of the real estate sector due to the issuance of reports of unfavorable urban compatibility that is contributing the Department of Urban Planning of the Javea Town Hall.
Given this situation, the Popular Party of Xàbia held an informative talk, where he explained to the large audience, what was the purpose of the new law and what was the problem that occurred in the town, requesting immediate action to the government team "so that local economic activity does not decline".
The popular explained that "With this Law, the Generalitat Valenciana intends to guarantee a tourism model that strengthens the tourist economy, but in Xàbia it will have the opposite effect because residents cannot register their homes as marked by the new regulations".
Operation of the new Law
From the 8 of July, the houses that are destined to rent for tourism and holiday purposes must be registered in the Tourism Register of the Valencian Community, but the law says that these houses will not have access to the register of tourist homes if they do not have an urban compatibility report to be issued by the Town Council of Xàbia. "And at this point there is the problem in Xàbia, since all the requests for urban compatibility certificates are being issued unfavorably from the Town Planning Department of the Xàbia City Council. Therefore, without said report, Xàbia tourist homes do not the house can be registered in the Tourist Rental Registry and as a result the owner cannot rent his house or else he incurs a very serious infraction that can result in a fine up to € 600.000 ”, explained the popular.
The PP noted that the reason why the City Council issues unfavorable urban compatibility certificates is due to the tourism rental activity in Xàbia does not adapt to our urban planning and nor to the uses provided for in our bylaws and although it seems contradictory , that the law of tourism itself says that the Valencian territory is a tourist destination by nature, or that Xàbia is one of the tourist municipalities par excellence of the Valencian Community, this has not even served to prevent the
problem when writing the law, or to put a solution from the moment the law was published.
PP proposals
According to the popular ones, the General Plan of Xàbia, "neither that of the 90 that is in force, nor that which is in the approval phase is planning tourist use as such" , and before such assumption "All municipalities are interpreted in which way they can issue a certificate of favorable urban compatibility without having the intended use in their planning, but this has not happened in Xàbia, which directly chooses to issue unfavorable certificates, arguing that it only has a place hotel use and not tourist housing ".
From the Popular Party we asked the government team to "Do not let more time pass, you have to amend the law immediately and urge that without further delay the Chulvi government expedite the efforts to solve this problem in our General Plan, since, otherwise, it will cause irreparable damage to the income of the population of Xàbia. Meanwhile, we propose that we choose to issue favorable urban compatibility certificates for homes that are destined for tourism purposes in a tourist town such as Xàbia ".
"We believe that urgent or provisional solutions must be sought, if necessary, until the long process of incorporating tourist use into our General Plan is processed or, if it is for the Generalitat's sake, to modify the law and cease the obligatory nature of the report , but not paralyze the economy of Xàbia, because if tourists do not have
