The final judgment of the Supreme Court on an appeal presented by the Javea Town Hall and the owners of one of the businesses located in the Cala Granadella order "To declare the expiration of the procedure for restoring legality and to initiate a new procedure without the action being considered prescribed. It also orders the City Council to exercise its powers in relation to the activity license in order to purge the irregularities detected".
It refers to the demolition of some works carried out, in 2003, at Bar Rosita. According to the sentence, "inadmissible for processing" the appeal of both parties "for breach of the requirements that the Law imposes on the writing of preparation of the resource to lack of sufficient foundation".
This appeal was filed against the judgment of July 1, 2020 of the Superior Court of Justice of the Valencian Community by which it dictated the closure of the activity of the Rosita Restaurant, ordering the restoration of legality by demolishing the illegal works.
