El Javea Town Hall has received a new sentence on urban infringement in the Cala Granadella. It is about illegal works carried out in one of the restaurants.
The judgment, coming from the Supreme Court, corroborates the judgment of the Superior Court of Justice whose conviction was appealed by both parties in 2020.
The ruling of the Supreme Court, as this wording has been able to verify, revokes the appeals presented by the City Council and the owner of the premises alleging that "the requirements of the article have been breached, by not clearly citing or sufficiently substantiating the concurrence of any of the assumptions that allow assessing the objective appeal interest and the convenience of a pronouncement of the Administrative Litigation Chamber of the Supreme Court.
The judgment also imposes the procedural costs to the appellants, whose maximum quantitative limit is set, with respect to the Jávea City Council, at 1.000 euros, plus VAT if applicable, in favor of the one who was Town Planning Councilor until 2003, Vicente Ortolá, appealed party and person, and, to the owner of the premises, in € 2.000, plus VAT if applicable, in favor of the former mayor who has opposed the admission of his appeal.
