The Local Police closes two other premises in Punta del Arenal de Xàbia

At 13:00 p.m. and with customers on the terrace, several Xàbia local police officers have ordered the closure of the two premises that were still open in Punta del Arenal.

Acqua and Bambula have been the two restaurants that have had their doors sealed today after last Friday, May 13, it took place at Salt and Botánico.

A few days ago, the manager of the Javeacompany business group appealed to the judge to prevent this closure. At the moment, this has not been possible and the agents have placed the seal once the clients have finished consuming.

In response to this action, he has issued these statements: "unfortunately, the town hall has complied with its threat to seal off our Bámbula and Acqua stores. You can understand how unfair and discriminatory this situation is with this simple question: How many businesses currently lack the corresponding license and continue with
your activity?. Answer: A great majority!" Edgar Slama said in a statement.

The manager of Javeacompany noted that their premises have "an administrative OCA (this is a document that certifies that we have all the necessary documentation, as well as the relevant safety, fire, accessibility tests... to carry out our activity)".

Slama asks the administration "and his boss to have the courage to answer this question" and added that he hopes "as on many other occasions, that justice will allow us to open, given that we consider the actions of the administration to be illegal."

Now it's time to wait for the court's decision. With these two closures, there are already six of the seven premises that have closed their doors for being in operation without the corresponding activity license.

The venue that remains to close is the Achill nightclub, which has the maximum term stipulated on Friday, May 20. If the company does not do it voluntarily, again the agents must interrupt the activity and put the seal.

    As in almost all things in life, common sense must be applied. The Rules are there to be applied, if not what are they for… I sincerely believe that both the City Council and the employer have every interest in fixing this situation. Now, it is true that entertainment venues, by their nature, can cause inconvenience, but if the Regulations are applied correctly, I believe that their activity is beneficial for the economy and can be compatible with the freedom and tranquility of those who live nearby. What cannot be, and it is a very Spanish case, is that everything is open until the wee hours of the morning every day of the summer... there have to be limits.

      Given the reactions caused by the seal of certain entertainment venues in the Arenal beach area (Salt, Botánico, Atalaya, Baltasar, Bambula, Acqua and Achill), the Xàbia City Council wishes to clarify the following points:
      -The closure order is due to the fact that the hotel businesses lack an activity license due to different deficiencies in their premises and that there are citizen complaints about the inconvenience they generate, complaints that have opened an investigation by the Valencian Anti-Fraud Agency.
      – Said deficiencies refer to the local urban regulations, to the requirements of economic activity and the sectorial regulations of coasts.
      – The premises have open infringement files for years and within this procedure they have been required on several occasions to solve the aforementioned problems.
      – The owners of the premises have been aware of this situation for years, as well as of the measures they should take to regularize the activity of their premises. Instead of focusing on it, they have chosen to delay the process with appeals and arguments, a path that, they knew, would have an expiration date.
      -The Valencian Anti-Fraud Agency, upon investigating the legal situation of the premises and verifying that they lacked a license, gave the City Council a deadline to formalize its closure.
      -The City Council has respected all the mandatory steps and hearings and has finally closed the infraction file with a definitive closure order (on which it is no longer possible to appeal administratively) to the seven premises.
      Two of the affected businesses - Atalaya and Baltasar - have accepted the order and voluntarily closed within the period granted to them for it, initiating the urban steps for its reopening. From the City Council we appreciate your cooperation.
      The rest of the businesses have not complied with the order and therefore the subsidiary execution has been activated. Four of the stores have already been forced to close: Salt, Botánico, Bambula and Acqua. It is also planned -and the person in charge has been notified- to close the Achill nightclub this Friday.
      – The municipal precinct is the last resource of the Administration to enforce the closure order to the premises that have not complied with it.
      – We regret having reached this forced measure and the consequences it may have on the workers of these companies. We value the effort that has been made with these catering establishments to dignify this area of ​​Arenal, but observing the rules in any area is mandatory and common.
      – We want to clarify that this action does not mean a definitive cessation of the activity. In fact, if those responsible for the businesses correct the shortcomings and infractions that may have been committed, the affected premises will be able to obtain a license and resume their normal activity.
      Finally, the Xàbia City Council wants to recall its commitment to the entire business fabric of the town and, especially, to the hospitality sector. Proof of this is the substantial aid mobilized to deal with the effects of the pandemic, the suspension of the rate of occupation of terraces, the implementation of new terrace spaces where they did not exist, the training by the municipality of works related to the sector, the financing and dissemination of gastronomic fairs and the constant dialogue with the hotel industry so that certain measures are advantageous for their activity.
      We hope that this unpleasant situation ends soon and, for our part, we will provide the necessary means to make it so.

      If it is illegal work (undeclared work), it is not a matter for the local authorities, but for the social security and financial authorities.
