The City Council of Xàbia has opened a way to revoke the building license granted last July, considering that the project may distort the idiosyncrasy of this coastal strip. The mayor, José Chulvi, asked that the administrative file be thoroughly reviewed and an irregularity was finally found.

According to the documentation, the license was requested at the 30 of May of 2017 in the afternoon, hours before the preliminary version of the new General Structural Plan was made public, but the fees corresponding to this license were paid on June 22, when the New urban regulations were already in the phase of public participation and consultations. Process in which, by plenary session, it was agreed to suspend licenses and programming agreements for two years "In those areas where the new ordination is not compatible with the old one", as is the case of the area affected by this project.

The Tax Regulatory Ordinance of Xàbia considers the payment of the fee as a requirement "essential" to process the license; therefore, the technicians reconsider the date of application and understand that it is the 22 of June, something key in this file.

Now, a resolution of the mayor proposes to initiate the process to revoke the permit and declare injurious the license granted last July "Because of the incompatibility with the new ordination and given that it could cause damages that are impossible or difficult to repair".

The promoters will be heard to formulate allegations if they consider it and then, the resolution will be taken to a full vote.
