Ecologists in Action Marina Alta presented, yesterday Thursday, a formal complaint to the City Council of Xàbia, for entry registration, for the closure of access to the Cala del Francés. Through this complaint, the environmental group tries to put an end to the privatizations that constantly affect the land close to the maritime-terrestrial public domain.

According to Ecologists in Acción Marina Alta, "The City Council of Xàbia has the right and the duty to eliminate any obstacle to access the use of the Cala del Francés. And not only to this, but to any other maritime-terrestrial public domain."

Closed access to the Cala del Francés

The collective insists that "The City Council has to promote access to the cove publicly and free of charge and it has to fight and ensure its conservation. But you have to understand that in order to be able to freely use the Cala del Francés, it is necessary that you can simply access". A statement that he already made public, last November, in which he already showed complaint about the closure of this access.

Coastal Law

In the complaint issued by Ecologists in Action, it indicates that "The Coastal Law establishes the so-called easement of access to the sea. This easement prevents works or private facilities from interrupting access to the sea. The easement determines that a person is not the exclusive user of all rights to the land of the lands close to the sea. These easements are imposed on individuals in favor of the community. They respond to the idea of ​​social function because we can all enjoy public goods, such as the sea. "

The letter from the environmental group remarks that "Both the Coastal Law and the General Coastal Regulation make it clear that, if the works are carried out, the interested parties have to provide an alternative and analogous solution to access the cove. If the historic closure of the Cala del Francés is maintained , the only remaining possibility to access would be either from the sea, or to cross the slope of the cliff of the adjacent cove - La Caleta. This solution is not at all similar to the way to go down to the cove that previous generations have been doing . We do not say all this on a whim, but because, as the situation is currently, it is absolutely unfeasible to access the Cala del Francés on foot, saving the gap between the two coves ".

Likewise, the environmental group of the Marina Alta indicates that "The works carried out -that is, the placement of padlocks that make the existing door is closed- make it impossible to access La Cala del Francés. The environmental value of the coast, its richness and biological diversity are inherent to it. The coast and the sea is a right and a duty. Consequently, its protection is an attitude that both the public powers and each one of us must maintain. "
