The Xàbia opposition criticizes "the paralysis" of the local government in restoring the urban legality of an official's home

The three spokespersons of the parties that make up the opposition in Xàbia, Partido Popular, Compromís and Ciudadanos,
They have ruled on the paralysis of the Chulvi government when it comes to restoring the urban legality of the municipal architect's home.

According to the representatives of the three formations, Rosa Cardona, Juan Cardona and Enrique Escrivá, in a statement, "the clear example of the inactivity or disinterest of the local executive when it comes to clarifying the suspicions of illegality that hang over the house, is that the Town hall It has taken more than 3 years to commission the tastings on that property”. The opposition brief continues to point out that "in addition, in the case of a building located in the granadella, whose works have been declared non-legalizable by final judgment".

The opposition states that they have been able to verify, "after learning about it from the media, that the housing works would not only have exceeded those of the license that was granted, but that the building could have been practically rebuilt again, practically from scratch With this, everything points to the fact that the Chulvi government has been hitting the postpone button when it comes to complying with the requirement of the municipal technicians regarding the need to carry out these tests on the home to verify suspicions of illegality.

Three-year delay in home tastings

In this regard, the spokesmen for PP, Compromís and Cs wonder why this verification has been delayed for 3 years, which has also been requested several times from the local government through technical reports. “All of this leads us to
ask ourselves how the Chulvi government can consent, even by omission, to the fact that, it seems, a house has been built or rebuilt practically from scratch in Granadella, in Non-Developable Land of Special Protection. That is to say, a land with the maximum protection granted by urban planning regulations, precisely taking into account the ecological and environmental value of an emblematic area of ​​Xàbia such as Granadella”.

In the opinion of Rosa Cardona, Juan Cardona, and Enrique Escrivá, the fact that urban infractions are not studied or executed quickly in Xàbia sets a bad precedent, because "it implies ignoring or, in the worst case, supposes that, Perhaps, they are playing with the deadlines when complying with an essential obligation of the City Council, such as restoring the legality of a home on which a sentence weighs that declares that the works carried out are not legalizable.

In addition, the opposition councilors have wondered if this passivity on the part of the local executive regarding a house that violates the law may be related to the fact that its owner is the municipal architect of Xàbia.

“Above all, because it is disturbing that the new General Plan, approved by the Chulvi government, which is currently being processed, and which is going to declassify almost 10 million square meters of land in Xàbia, will coincidentally reclassify the land of the house on which the suspicions of illegality fall, cataloging the land of said building as urban, ”says the statement issued by the opposition.

With all this, the representatives of the different formations of the opposition in Xàbia have concluded by pointing out: "We do not know for what reason the actions that correspond to the City Council have been delayed over time to return that house to the previous legality. Nor do we know why this new General Plan requalifies as urban land a dwelling scattered with respect to the Traditional Historical Nucleus in which Tio Català Avenue has been catalogued, beyond the peculiarity that this building belongs to the head of urban planning in Xàbia. What we do know is that the Chulvi General Plan would mean whitewashing and 'de facto' protecting a home that has a long shadow of illegality, which would go unpunished forever”.
