Citizens for Jávea denounces that the new General Plan makes the town of Granadella developable

The plenary session held at the Javea Town Hall This Thursday, the last of this legislature, had on the agenda to approve the additional documentation to the Proposal for the General Structural Plan of Xàbia for the purpose of issuing the Strategic Territorial Environmental Declaration (DATE)

A decision that has only had the votes in favor of the PSPV, while Compromís has abstained and Ciudadanos por Jávea, Partido Popular and the non-attached councilor have voted against. The reason for this opposition to the vote and not supporting the approval of the General Plan by the opposition is due to the fact that, according to what the political formations have indicated, "the town of the granadella ceases to be Undevelopable Land of Special Ecological-Landscape Protection to be reclassified to Urban Land".

Given this fact, the mayor of Citizens for Jávea (CpJ), Juan Ortolá, has denounced it and has stated that it will transfer its position to the Ministry so that it can rule on this fact and take the legal consequences. Likewise, the intervention has been the following.

In the PGE proposal approved by the Socialist group with the opposition parties voting against (PP. CPJ, Compromís and Ciudadanos) the town of Granadella as HISTORICAL CENTER RESIDENTIAL – ZUR-RE-NHT (Residential Urbanized Zone-Traditional Historical Center). High density.

In this proposal for the General Structural Plan, in the definition of the area it says: "this area is considered integrated into the urbanized residential area Casco Urbano (ZUR-RE 1)". That a "Special Protection Plan with a landscape program: Urban Image (urban and developable edge planning / Historical Nuclei of Xàbia)" must be drawn up.

It is at least curious that in order to protect (as they say in the PGE) a Non-Developable Land of Special Ecological-Landscape Protection, it is reclassified to URBAN. As curious as that in point 1.3.7.2. "Proposed urban land" justifies the inclusion of the "Historical Nucleus of La Granadella considering that it is one of the three historical nuclei of Xàbia (La Vila, Duanes and La Granadella)".

The town of La Granadella is a land protected in the PGOU 90-91 for its values ​​to preserve, land that meets the requirements of the European Directive 92/43/CEE, and which has meant that it is considered a SCI Site of Community Interest. Land that in no case has lost the environmental values ​​that implied its protection and that therefore it would be illegal to reclassify it as urban, as is intended in the proposal approved by the socialist group.

The town of La Granadella is located at the end of the slope (vessant) of La Granadella. Are you affected by danger of flooding? Has the flooding study of the General Structural Plan taken this into account? Can a land that may be affected by flood hazard be reclassified?

The solution to the preservation of the Granadella must be real and based on a Comprehensive Environmental Action Plan, recovering the physiognomy of the original town and acting on non-prescribed infractions. As long as what is sought is the conservation of a natural setting.

The town of La Granadella already has the adequate protection regime granted by the Minister of Public Works, Urban Planning and Transport on March 8, 1991, NON-DEVELOPABLE LAND WITH SPECIAL ECOLOGICAL-LANDSCAPE PROTECTION. What you have to do is respect it and not protect reforms and new illegal constructions that destroy the essence of the town with the reclassification to urban.

We are faced with a proposal for the Reclassification to Urban of a Non-Developable Land of Special Ecological-Landscape Protection, in an area in which different and confusing urban planning forecasts concur, among which it should be noted that the reclassified urban land of Tio Catalá street will be has provided for a scope of the Special Plan that exceeds the area of ​​the BRL (Local Relevance Asset) and that extends to a part of the disseminated without justifying or making clear the legal consequences that such expansion will derive for those lands and the houses that are there.

The rules must be crystal clear so that there is no margin for discretion of whoever has to apply the Plan. For all these reasons, we request the Ministry of Territorial Policy, Public Works and Mobility as Environmental Body, an express pronouncement on the possibility of Reclassifying to Urban a land whose current classification is Undeveloped Land of Special Ecological-Landscape Protection, and legal consequences in its case of the different protection regimes.
